General Terms and Conditions for Data Roaming Services from Galaxus Travel eSIM
Last updated: October 2026
Please note: Only the German original of these General Terms and Conditions for data roaming services from the Galaxus Travel eSIM is legally binding. The English, French and Italian translation is provided for information purposes only and has no legal force. By accepting these General Terms and Conditions, you automatically accept the German original.
1 Scope, Parties and Components of the Contract
These General Terms and Conditions for data roaming services of Galaxus Travel eSIM («GTC»), together with the corresponding order and additional contract components, form the contract between Digitec Galaxus AG, Pfingstweidstrasse 60b, 8005 Zurich («Galaxus Travel eSIM») and you («customer») regarding the supply and use of data roaming services abroad in the form of data packs via eSIM profiles («services») from Galaxus Travel eSIM. The type and scope of the services are determined by the order, these General Terms and Conditions and the other contract components.
The following documents are integral parts of this contract in descending order of priority:
- Service descriptions and further conditions
- These General Terms and Conditions
In addition, the general privacy notice of Digitec Galaxus AG and the data protection information regarding Galaxus Travel eSIM apply.
The contract components are available on abos.galaxus.ch and are valid in their current version. Galaxus Travel eSIM can also send the customer the contract components by e-mail. By completing the order, the customer confirms that they have read and accepted all terms of the contract without modification and that the information provided is accurate. The customer is liable to Galaxus Travel eSIM for the correctness of information or for damages resulting from incorrect or insufficient information.
2 Commencement, duration and termination
2.1 Commencement and duration
The contract takes effect upon completion of the data pack order and remains in effect for the duration of the data pack specified at the time of order.
An active Galaxus Mobile subscription is required for the contract between Galaxus Travel eSIM and the customer to be concluded and take effect, and for the customer to use the services. The requirements for registering for or ordering a Galaxus Mobile subscription are set forth in the «General Terms and Conditions for Mobile Services Provided by Galaxus Mobile», available at abos.galaxus.ch.
To use a data pack, the customer must have an active eSIM profile on their mobile device (e.g., mobile phone or tablet). The customer installs this eSIM profile on their own after ordering a data pack. A data pack is considered activated as soon as the eSIM profile connects to the mobile network of the respective foreign mobile network provider.
If, after activation is complete, it turns out that the customer provided incorrect or incomplete information during the registration process for their Galaxus Mobile subscription, Galaxus Travel eSIM may deactivate or delete eSIM data packs, including the associated eSIM profiles, without compensation.
Individuals aged 18 and over residing in Switzerland are entitled to conclude contracts.
The number of eSIM profiles that can be active at the same time is limited. Galaxus Travel eSIM also reserves the right to reject orders for data packs if it suspects misuse.
2.2 Termination
2.2.1 Termination of the contract
The customer may terminate a data pack at any time prior to its activation by canceling the data pack. The customer must submit the cancellation or termination through their customer account («customer account»), which is accessible via abos.galaxus.ch. Terminations by letter or e-mail will not be accepted. If the customer cancels or terminates the data pack in a timely manner, the amount already paid for the data pack will be automatically refunded on the next invoice. Once a data pack has been activated (the eSIM profile connects to the mobile network of the foreign mobile network provider), cancellation is not permitted, and the full price of the data pack is due. Refunds are not permitted.
If the data pack is not activated within 60 days of the order, it will be automatically canceled, and the amount already paid for the data pack will be refunded in a future invoice.
If the customer has multiple data packs, they can cancel or terminate them individually through their customer account, as long as they have not yet been activated.
If the customer cancels their Galaxus Mobile subscription, they may order additional data packs until the Galaxus Mobile contract ends. Upon termination of the Galaxus Mobile contract, data packs that have already been activated may be used until the data allowance is completely used up; however, this cannot be guaranteed in every case. However, they will no longer be able to order new data packs starting at that time.
Further requirements for cancelling a Galaxus Mobile subscription are set forth in the «General Terms and Conditions for Mobile Services Provided by Galaxus Mobile», available at abos.galaxus.ch.
2.2.2 Termination for an important reason
If there is an important reason, Galaxus Travel eSIM has the right to terminate the contract without notice and compensation. An important reason exists in particular if
- there are indications that the customer is using the services illegally, contrary to contract or improperly,
- a competent domestic or foreign authority orders that the services no longer be made available to the customer,
- the mobile network of the relevant mobile network operator or of third parties or their use by the customer is impaired,
- There is reason to believe that the customer provided incorrect or incomplete information when entering into the contract or during the registration process for their Galaxus Mobile subscription,
- the customer is in default of payment,
- overriding public interests require this.
The customer has the right to terminate the contract immediately for good cause. An important reason exists in particular if
- Galaxus Travel eSIM culpably commits an ongoing serious breach of contract and does not rectify this despite a warning from the customer within a reasonable period of time,
- there is no network availability (at least uninterrupted for more than 7 days) in the country for which the data pack was ordered (except in case of force majeure),
- in the event of the customer’s death.
2.2.3 Deactivation or deletion of the eSIM profile
Unused eSIM profiles without a data pack that has been ordered or activated will be automatically deactivated or deleted after 180 days.
3 Services from Galaxus Travel eSIM
3.1 General
When a data pack is ordered by adding it to the customer account, Galaxus Travel eSIM provides the customer with an eSIM profile via the customer account, which the customer can use on mobile devices (e.g., smartphones or tablets) to access the mobile networks of mobile network providers abroad for data connections (data roaming).
The services are provided through one or more eSIM platform providers («system partners») selected by Galaxus Travel eSIM. For the provision of its services, Galaxus Travel eSIM may at any time call in further third parties at home and abroad.
The scope of services provided by Galaxus Travel eSIM includes the provision of one or more eSIM profiles. Customers can add one or more data packs to an eSIM profile.
The data packs cover individual countries or specific regions. Each data pack includes a specific amount of data and a specific validity period, calculated from the date of activation. The information mentioned above is displayed in the customer account when the data pack is ordered.
As a general rule, an existing eSIM profile can only be topped up with the same data pack type that was originally purchased. Switching to a different data pack, especially one with different country or regional coverage, may require a new eSIM profile.
Data packs are billed individually.
Galaxus Travel eSIM reserves the right to extend, restrict, discontinue or otherwise adapt the data packs and their associated terms and conditions at any time, even after they have been ordered. If the customer has ordered or is already using data packs that are affected by such changes, the customer will be notified in an appropriate manner.
The scope of service does not include a phone number for making or receiving calls and for sending or receiving SMS/MMS messages via a cellular network.
3.2 Warranty
Galaxus Travel eSIM guarantees the careful provision of the contractually agreed services. Galaxus Travel eSIM particularly strives for a high availability of its services. However, Galaxus Travel eSIM does not assume any guarantee or assurance for
- the uninterrupted and trouble-free functioning of the infrastructure and its services as well as their security,
- continuous and area-wide availability of services,
- specific transmission times, speeds or capacities,
- a specific availability and quality of data traffic, as well as in regard to operation and support,
- the availability of individual wireless technologies and standards,
- the provision or maintenance of certain technical means (e.g. infrastructures, platforms, transmission technologies and protocols and user interfaces) and the provision or maintenance of services accessible through them,
- the retention of certain countries and regions for data packs,
- the integrity of data transmitted or received via the infrastructure of the respective mobile network operator or the infrastructures of third parties,
- content or services created by or accessible from third parties;
- the protection of the Mobile Network Infrastructure against unauthorized access or interception,
- the protection of the customer or their devices and data against harmful software, viruses, spamming, trojans, hackers, spyware, phishing or other criminal attacks by third parties,
- the avoidance of data loss,
- safety precautions on the infrastructure of the respective mobile network operator to avoid damage to the customer’s equipment.
Further, Galaxus Travel eSIM does not assume any responsibility for
- content that the customer transmits or has processed by Galaxus Travel eSIM or third parties, or that the customer makes available to third parties,
- content that the customer receives via mobile networks,
- the accuracy, completeness, timeliness, legality and expediency, availability and timely delivery of information created by third parties, retrievable from third parties or made available via the services of Galaxus Travel eSIM.
3.3 Mobile Network, Coverage, and Maintenance
Mobile communications coverage abroad is dependent on the mobile network of the respective mobile network provider and its technical and operational capabilities. In countries with several possible mobile network providers, Galaxus Travel eSIM or the system partner determines the respective data roaming partner.
The network coverage information provided by Galaxus Travel eSIM is not binding. Gaps in mobile communications coverage can also occur in well-served areas and especially in buildings. For legal, technical or factual reasons, an existing mobile phone coverage at a certain location can deteriorate or be completely omitted.
Wi-Fi is not included in the Galaxus Travel eSIM plan.
Galaxus Travel eSIM, the system partner, or the local mobile network operators reserve the right to temporarily restrict or interrupt services, e.g., as a result of maintenance work, the introduction of new technologies, troubleshooting, or capacity constraints. The occurrence of such an event does not entitle the customer to terminate the contract for cause. Galaxus Travel eSIM, together with the system provider, strives to correct faults within its sphere of influence within a reasonable period of time during operating hours. If Galaxus Travel eSIM is claimed by the customer due to malfunctions, the cause of which does not lie in its infrastructure, the associated costs may be charged to the customer.
3.4 Bandwidths, speeds and technologies
With regard to data traffic over the mobile network, there is no assurance as to bandwidths or transmission speeds. The bandwidths and transmission speeds stated by Galaxus Travel eSIM are the best possible performance and cannot be guaranteed. The actual bandwidth or transmission speed depends, for example, on the network coverage, the location, the network load, the network quality, the network expansion, the device used and other factors and may be lower than the specified maximum data. The uninterrupted transition between different technologies cannot be guaranteed. Galaxus Travel eSIM, the system provider, and the respective mobile network operator are entitled to discontinue older technologies and standards. There is no entitlement to a particular technology or a particular standard.
3.5 Blocking
Galaxus Travel eSIM may block or restrict services in whole or in part without prior notice if
- there is an important reason (Section 2.2.2),
- the blocking or restriction is in the presumed interest of the customer, e.g. in the event of misuse by third parties,
- in the event of justified doubts as to compliance with the payment obligations pursuant to Section 5.3.
The blocking or restriction may be maintained until the reason for the blocking or restriction ceases to apply. If the customer is responsible for the reason for the blocking or restriction, or where Galaxus Travel eSIM is not at fault, the customer’s obligation to pay for the affected services remains unaffected during the blocking or restriction. In addition, subject to any contrary provisions under telecommunications law, Galaxus Travel eSIM may charge the customer a fee for blocking and unblocking the relevant service, in accordance with the rates published on abos.galaxus.ch.
3.6 Support
For support, FAQs as well as a contact form are available to the customer at abos.galaxus.ch. In addition, customers can contact Galaxus Mobile’s customer support team during business hours with support requests; the team handles inquiries regarding Travel eSIM. Galaxus Mobile’s customer support team strives to respond to support requests as quickly as possible.
4 Prices
The current prices displayed in the customer account apply. The prices of data packs are subject to change at any time without prior notice. The obligation to pay begins when the data pack is ordered. Unless otherwise indicated in the customer account when ordering a data pack, the following additional terms apply:
- No refund shall be issued for paid promotions or voucher campaigns that result in the reduction of a specific price if the fee in question is subsequently reduced.
- Discounts cannot be combined.
When the validity period of an activated data pack expires, any remaining credit will be forfeited. No refund of any remaining balance shall be granted.
5 Invoicing and terms of payment
5.1 General
Services purchased by the customer are billed via invoices issued by Galaxus Mobile for the Galaxus Mobile subscription. Invoices are prepared on the basis of the technical records of Galaxus Travel eSIM and/or its system partners. Galaxus Travel eSIM (via Galaxus Mobile) may consolidate several of the customer’s invoices and include minor amounts together with a subsequent invoice. Partial billing units are charged as full units. Only services for which billing data is available are taken into account in the billing process. Claims relating to data delivered subsequently — as may be the case with data roaming connections — may be asserted with later invoices. Galaxus Travel eSIM (via Galaxus Mobile) may charge the customer for amounts owed for the use of third-party services together with the billing of its own services. Invoices are visible in the customer account.
Any objections to an invoice must be submitted by the customer, together with reasons, by email to Galaxus Mobile customer support within 30 days of receipt of the invoice. Otherwise, the invoice shall be deemed accepted by the customer. If the objections relate only to a partial amount of the invoice, the customer must pay the undisputed partial amount. Refund claims by the customer for amounts overpaid shall be credited to the customer’s billing account and offset against the next invoice amount. Upon termination of the contract, all outstanding claims and amounts shall become due.
5.2 Payment methods
The customer undertakes to pay the invoiced amount by valid credit card or TWINT. No other forms of incoming payments will be accepted. Payment by TWINT is permitted only for private customers. The payment method is saved in the customer account for recurring transactions. Only the credit card providers listed on abos.galaxus.ch are accepted. Invoicing and/or charging of the credit card or TWINT is carried out automatically on a monthly, retroactive basis.
5.3 Default
If the customer does not fulfill his or her payment obligation, in particular because the debit cannot be carried out properly due to restrictions on the credit card or TWINT on the part of the customer, the customer shall be in default immediately and without further ado. The delay shall also occur if the customer raises objections to a partial amount of the invoice but does not pay the partial amount not objected to.
Galaxus Travel eSIM (via Galaxus Mobile) reserves the right to charge default interest of 5 %. In addition, the customer shall bear all costs incurred by Galaxus Travel eSIM as a result of default in payment. In particular, after an initial free payment reminder sent by SMS or e-mail, the customer will be charged a fee of CHF 30.– per additional payment reminder. Galaxus Travel eSIM can call in third parties for debt collection at any time. The customer must pay minimum fees for this and pay these directly to the third party called in. In addition to the minimum fees, the customer must pay individual expenses and disbursements of the third party involved that are necessary for the collection.
If the customer is in default, Galaxus Travel eSIM may, as far as legally permissible, suspend the provision of individual or all services, take further measures to mitigate damages and/or terminate the contract without notice and compensation.
6 Duties/services of the customer
6.1 Payment
The customer is obliged to pay for the purchased services in due time.
6.2 Legal and contractual use and misuse
The customer is responsible for the legal and contractual use of the services. The services are intended exclusively for the customer’s personal use during temporary stays outside Switzerland. The customer may use an eSIM profile (and, based on that, one or more data packs) in a single country outside Switzerland for a maximum of 60 consecutive days.
Furthermore, the services may not be misused. The following in particular shall be deemed to be contrary to law or contract and/or abusive:
- a misuse or use that is not in accordance with the intended purpose of the services (in particular for a permanent connection in a router or hotspot device, as well as for specialized applications such as surveillance, machine-to-machine, and direct-dial connections),
- the harassment or disturbance of third parties, in particular the obstruction of third parties in the use of telecommunications services,
- Hacking (e.g. intrusion attempts into the infrastructure of third parties), spying on other users or their data and fraudulent attacks (e.g. phishing),
- the transmission or disclosure of illegal or immoral content,
- the commercial redistribution of the services or the provision of telecommunications services based on the services purchased,
- the distribution of unfair mass advertising (spam),
- the distribution of harmful software (e.g. viruses, Trojans, etc.),
- the connection of incompatible devices to the infrastructure of the network operator,
- unauthorized access to or use of data, systems and network elements.
If Galaxus Travel eSIM proves, or if there are indications, that the customer (or persons under their responsibility, see also clause 6.4) is using the services unlawfully, in breach of contract, or improperly, Galaxus Travel eSIM is entitled to direct the customer to use the services lawfully and in accordance with the contract, to change, block (e.g. by deactivating an eSIM profile and the associated data packages) or restrict (e.g. by imposing limits on the number of data packages or eSIM profiles that can be ordered) the services without prior notice and without compensation, to terminate the contract for the data package or the relevant connection (Galaxus Mobile subscription) without notice and without compensation, to take other appropriate measures and, where applicable, to demand damages as well as indemnification against third-party claims. The same applies in the event of incorrect or incomplete information provided by the customer as part of the registration process for his or her Galaxus Mobile subscription. If there are signs of illegal, non-contractual or abusive use, the customer is obliged to provide Galaxus Travel eSIM with information about the use. Furthermore, the customer must notify Galaxus Travel eSIM via the contact channels indicated on abos.galaxus.ch in the event of an established or imminent misuse of the services (including misuse at the expense of the customer).
6.3 Responsibility for content
The customer is responsible for the content of the information (voice and data in any form) that they have Galaxus Travel eSIM transmit or process, or that they make available to third parties.
6.4 Responsibility for the use of eSIM profiles
The customer is responsible for all use of their data packs, including use by third parties.
As the contract holder, the customer bears full responsibility at all times for the use of all eSIM profiles assigned to him or her and the data packs purchased through them, as well as for the payment of all resulting invoices. This responsibility applies even if an eSIM profile and the associated data pack are shared with third parties or used by third parties. Galaxus Travel eSIM has no knowledge of other individuals who actually install the eSIM profiles and use the associated data packs; the customer remains fully responsible for their use. In the event of any use of individual eSIM profiles and associated data packs that is unlawful, in breach of contract, or abusive, or in the event of late or non-payment, Galaxus Travel eSIM is entitled to take appropriate measures with respect to all of the customer’s eSIM profiles and data packs.
If the customer allows minors to use eSIM profiles and associated data packs or other services obtained from Galaxus Mobile, the customer is responsible for complying with the applicable youth protection regulations. With regard to the Galaxus Mobile subscription, Galaxus Mobile provides blocking options—to the extent technically feasible.
6.5 Devices of the customer
The use of the services requires the use of suitable and compatible devices (e.g. smartphones or tablets incl. dedicated software) by the customer. The customer is responsible for the purchase, installation, functionality and legal conformity of these devices. The eSIM chip used to install eSIM profiles is a component of the customer’s device. Galaxus Travel eSIM does not grant the customer any investment protection.
Galaxus Travel eSIM, the system provider, and the mobile network operator are entitled to access the devices used by the customer via the mobile network for the purpose of configuration, maintenance, optimization, or expansion of their services, and to view, modify, update, or delete technical data or software stored on them. In the context of remote maintenance, Galaxus Travel eSIM, the system provider, and the mobile network operator have access to those customer files that are directly related to the device’s configuration and services. Galaxus Travel eSIM is not liable for any damage to the customer’s equipment occurring after remote maintenance.
6.6 Security instructions, passwords, etc.
The customer must follow the security instructions provided or published by Galaxus Travel eSIM. In particular, the customer must regularly secure data and carefully store access data (login) and password and not pass them on to unauthorized third parties. If login credentials or password are lost, or a device with an activated eSIM profile is lost, the customer must notify Galaxus Mobile customer support immediately. Until that time, the customer is in any case required to pay for the services obtained through the relevant connection (Galaxus Mobile subscription) (e.g., in the event of interim use by unauthorized third parties).
The customer has to protect their devices and data against unauthorized access by third parties. They shall take state-of-the-art measures to prevent their equipment from being used for the distribution of illegal or otherwise harmful content, in particular unfair mass advertising (spam), fraudulent messages (phishing e-mails/SMS) and harmful software (viruses, trojans, etc.).
The electromagnetic fields caused by the customer’s devices can interfere with the functioning of other devices such as hearing aids, pacemakers and household appliances. In order to prevent malfunctions, the safety measures specified by the manufacturers must be observed. The customer must inform themself about and comply with any prohibitions and restrictions on use (e.g. road traffic, air traffic).
6.7 Customer information
The provisions set forth in Section 6.7 of the General Terms and Conditions for Mobile Services Provided by Galaxus Mobile, available at abos.galaxus.ch, apply.
7 Liability of Galaxus Travel eSIM
In the event of a breach of contract, Galaxus Travel eSIM shall be liable – unless it can prove that it is not at fault – for proven direct property damage and financial loss, up to a maximum of the price of the relevant data pack per claim, but in no event exceeding the total amount the customer paid for Galaxus Travel eSIM services during the twelve months preceding the damaging event. Liability for indirect or consequential damage, in particular loss of profit and loss of data, is excluded to the extent permitted by law. Furthermore, Galaxus Travel eSIM is not liable for damages resulting from illegal, non-contractual or improper use of its services by the customer (or persons under their responsibility).
Galaxus Travel eSIM assumes no liability in cases of force majeure or for damages for which neither Galaxus Travel eSIM nor the network operator is responsible, or that result from the suspension, restriction, or termination of services by Galaxus Travel eSIM. Force majeure includes all unforeseeable events and events for which neither party is responsible, including in particular power failures and the occurrence of harmful software (e.g. viruses). In cases of force majeure, Galaxus Travel eSIM is also released from its obligation to perform.
8 Third-party services and goods
If the customer obtains services or goods from third parties («Third-Party Services») via their connection – including the eSIM profile and associated data pack – the customer enters into the contract for such Third-Party Services with the relevant third party, and that third party’s terms and conditions shall apply accordingly. In this regard, Galaxus Travel eSIM is not the customer’s contractual partner – neither with respect to the third-party services obtained nor with respect to payment – and assumes no liability or warranty for the third-party services; it cannot be held liable for them and cannot provide any information regarding them. In such cases, Galaxus Travel eSIM’s services are limited to providing technical access to the third party concerned and to the Third-Party Services.
9 Further provisions
9.1 Intellectual property
For the duration of the contract, the customer receives the non-transferable, time-limited and non-exclusive right to use the agreed services of Galaxus Travel eSIM in accordance with the contract. The content and scope of this right are set out in the contract. The customer is not entitled to any further rights. All rights to existing intellectual property or intellectual property arising from the performance of the contract with regard to Galaxus Travel eSIM services and products shall remain with Galaxus Travel eSIM or the respective authorized third party. If the customer violates Intellectual Property Rights of third parties and Galaxus Travel eSIM is held liable, the customer must indemnify Galaxus Travel eSIM in full.
9.2 Transfer
The transfer of the contract or of rights or obligations from the contract by the customer requires the written consent of Galaxus Travel eSIM. If the contract for the Galaxus Mobile connection (Galaxus Mobile subscription) is transferred to another person (change of account holder), any existing data pack contracts with Galaxus Travel eSIM will also be transferred. Galaxus Travel eSIM is entitled to transfer or assign the contract or any rights and obligations arising therefrom (including claims) to third parties.
9.3 Further provisions
Galaxus Travel eSIM reserves the right to change the services and/or terms and conditions (including prices and these Terms and Conditions) at any time or to discontinue individual services. The customer will be informed of any changes in a suitable manner (e.g. via e-mail, in the customer account, on the invoice or on abos.galaxus.ch).
Any changes requested by the customer or customer-specific collateral agreements, changes or supplements require the written consent of Galaxus Travel eSIM.
9.4 Set-off
The customer waives their right of set-off with regard to all claims against Galaxus Travel eSIM.
10 Applicable law and place of jurisdiction
The contract shall be governed by the laws of Switzerland. Place of jurisdiction is Zurich. Mandatory places of jurisdiction (e.g. in the case of consumers the place of jurisdiction at their domicile in accordance with Art. 32 of the Swiss Civil Procedure Code (CPC)) remain reserved.
